Terms of Service (Framegripper)

These Terms of Service (“Terms”) govern your access to and use of www.framegripper.com and any purchases, subscriptions, content, and related services provided by Framegripper (“Framegripper,” “we,” “us,” or “our”) (collectively, the “Services”).

By accessing the Services or purchasing any product or subscription, you agree to these Terms.

1) Overview of Framegripper Products

Framegripper sells eyewear retention products designed to help keep glasses more secure during daily activities. Our system generally involves applying an adhesive sticker behind the ear and attaching a magnet band to the glasses frame, then connecting the magnet to the sticker during wear. 

Important: Read and follow all included instructions before use (including proper placement and connection steps). 

2) Eligibility

You must be at least 18 years old (or the age of majority where you live) to purchase from Framegripper. By placing an order, you represent that you are legally able to enter into these Terms.

3) Purchases, Subscriptions, and Billing

A. One-Time Purchases

When you purchase a product, you authorize us (and our ecommerce/payment provider(s)) to charge the purchase price, applicable taxes, shipping fees, and any other charges disclosed at checkout.

B. Subscriptions

If you purchase a subscription, you authorize recurring charges according to the subscription terms shown at checkout (price, billing cycle, renewal timing). Subscriptions may renew automatically unless canceled in accordance with the cancellation instructions provided in your account/checkout flow.

C. Checkout and Payments

Purchases and subscriptions are processed through our ecommerce platform (Shopify). Your payment may be processed by Shopify and/or its payment partners.

4) Shipping and Delivery

We ship using third-party fulfillment/shipping providers. Shipping estimates are not guarantees. Risk of loss transfers to you when the carrier receives the package, to the extent permitted by law.

5) 7-Day Money-Back Guarantee and Returns

We stand behind our products. If your Framegripper product does not work for you, you may request a money-back guarantee subject to all conditions below:

A. Return Window

  • You must initiate a return within 7 days of delivery (based on carrier tracking).

  • Returns initiated after 7 days are not eligible.

B. Return Requirements

To qualify:

  • You must return the product within the return process instructions we provide.

  • Returned items must be in reasonable condition (same condition as delivered).

  • You must include proof of purchase (order number).

C. Refund Amounts

If approved:

  • We refund the purchase price paid for the returned product.

  • Shipping fees, expedited shipping, and duties/taxes (if any) may be non-refundable to the extent allowed by law.

  • Refund timing depends on processing and your payment method.

D. All Sales Final After 7 Days

After the 7-day window, all sales are final except where a refund is required by law.

E. How to Start a Return within 7 days of purchase date.

6) Safety, Warnings, and Proper Use (Read Carefully)

Framegripper products are intended for general consumer use. You are responsible for using the product safely and following all instructions and warnings.

A. Adhesive Allergy / Skin Sensitivity Warning

Our system may use adhesive stickers applied to skin (behind the ear). If you are allergic or sensitive to adhesives, do not use the product, and consult a qualified professional if you are unsure.

Before use:

  • Consider doing a small patch test on skin to check for irritation.

  • Stop use immediately if irritation occurs.

(Our included instruction card describes placing the sticker on the upper back of the ear and pressing firmly, and includes tips like clearing hair and replacing stickers as needed.  )

B. Magnet Safety Warning

This product may contain magnets and small parts.

  • Keep away from children and pets (choking/ingestion hazard).

  • Do not use if you have an implanted medical device that may be affected by magnets (e.g., pacemaker/ICD), unless cleared by your physician.

  • Keep magnets away from medical devices, magnetic storage media, and sensitive electronics.

C. Use at Your Own Risk / Assumption of Risk

You acknowledge and agree:

  • You are choosing to use the product voluntarily.

  • You assume all risks of use, including skin irritation, allergic reaction, discomfort, and any incidental damage arising from improper use.

D. Workplace/Activity Safety (OSHA-Style Notice)

If you use Framegripper products in a workplace or during physical activities:

  • Follow all applicable workplace safety rules, employer policies, and common-sense precautions.

  • Framegripper is not a substitute for required protective equipment or safe work practices.

  • Do not use the product in any way that creates a hazard, distraction, or unsafe condition.

7) Medical Disclaimer / Not FDA Approved

Framegripper products are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

  • Not FDA approved: Our products have not been evaluated or approved by the U.S. Food and Drug Administration (FDA).

  • Designed by an ENT surgeon: While the product may be designed with input from an ENT surgeon, this does not mean it is a medical device or that it provides medical treatment.

If you have a medical concern, consult a qualified healthcare professional.

8) Prohibited Use

You agree not to:

  • misuse the Services, attempt unauthorized access, or interfere with site operations,

  • scrape, copy, frame, mirror, or reproduce our website or content without permission,

  • use the Services for unlawful, harmful, or fraudulent purposes.

9) Intellectual Property

All website content, branding, product designs, and materials are owned by Framegripper or its licensors and are protected by intellectual property laws. You may not use our content without written permission.

10) Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the product will meet every user’s preferences or work in every scenario (including differences in anatomy, skin sensitivity, hair, eyewear frames, and usage conditions).

11) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRAMEGRIPPER AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, SUPPLIERS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRAMEGRIPPER’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICES OR PRODUCTS WILL NOT EXCEED THE AMOUNT YOU PAID TO FRAMEGRIPPER FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM IN THE 30 DAYS BEFORE THE EVENT THAT FIRST GAVE RISE TO LIABILITY.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12) Indemnification

You agree to indemnify and hold harmless Framegripper from claims, damages, liabilities, losses, and expenses (including attorneys’ fees) arising out of or related to your misuse of the Services or products, violation of these Terms, or infringement of any rights of a third party.

13) Governing Law

These Terms are governed by the laws of the State of Michigan without regard to conflict-of-law principles. Venue for disputes will be in Michigan, unless otherwise required by law.

14) Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new “Last Updated” date. Continued use of the Services after changes means you accept the updated Terms.
